This document contains a waiver and release of liability. By confirming a booking on EventSpace, you agree to the terms outlined below. This waiver applies to you and all guests attending the event under your booking.
1. Assumption of Risk
By booking an event space through EventSpace, you acknowledge and accept that attending events at private and commercial venues carries inherent risks. You voluntarily assume all risks associated with:
- The physical condition of the venue, including but not limited to uneven surfaces, stairs, pools, outdoor terrain, and other property features
- Activities undertaken during your event, including physical activities, sports, games, and entertainment
- Food and beverages prepared or consumed on the premises, including potential allergens
- Interactions with other guests, vendors, and third parties present at the venue
- Weather conditions for outdoor or partially outdoor venues
- Travel to and from the venue location
- The use of any equipment, amenities, or facilities provided by the Host
Note: This assumption of risk extends to all attendees of your event. As the booking Guest, you are responsible for communicating these risks to all attendees and ensuring they understand the nature of the venue.
2. Release of Liability
Liability Release
To the fullest extent permitted by applicable law, you release, waive, discharge, and covenant not to sue EventSpace Inc., its directors, officers, employees, agents, and affiliates from any and all claims, demands, liabilities, actions, or causes of action arising out of or relating to any loss, damage, or injury (including death) that may be sustained by you or any attendee of your event.
This release applies to claims arising from:
- Personal injury, illness, or death occurring at or in connection with the venue
- Damage to or loss of personal property at the venue
- Any act, omission, or negligence of the Host, venue staff, or other third parties
- The condition of the venue, including any defects, hazards, or insufficiencies not disclosed in the listing
- Any failure of equipment, amenities, or facilities at the venue
This release does not apply to claims arising from the gross negligence or wilful misconduct of EventSpace.
3. Property Respect
You and all attendees of your event agree to treat the venue and its contents with care and respect. Specifically, you agree to:
- Not damage, deface, or remove any property, furnishings, or equipment belonging to the Host
- Leave the venue in a reasonably clean and orderly condition, consistent with the condition upon arrival
- Report any pre-existing damage to the Host at the start of your event
- Report any damage that occurs during your event to the Host and EventSpace promptly
- Confine your event to the designated areas as specified in the booking and listing
- Not use the property for any purpose other than the event described in your booking
You accept financial responsibility for any damage to the venue or its contents caused by you or any attendee of your event. Damage costs may be deducted from your security deposit or charged to your payment method on file.
4. Compliance with Host Rules
Each venue on EventSpace has specific house rules set by the Host. By confirming a booking, you agree to:
- Review all house rules provided in the listing before your event
- Comply with all house rules, including noise restrictions, parking instructions, designated areas, and any specific prohibitions
- Communicate all house rules to your guests and ensure their compliance
- Adhere to the stated check-in and check-out times
- Not exceed the maximum guest count specified in your booking
- Follow the Host's instructions regarding use of equipment, amenities, and facilities
Violation of house rules may result in early termination of your event without refund, forfeiture of your security deposit, and potential account suspension on EventSpace.
5. Emergency Procedures
You agree to:
- Familiarize yourself with the emergency exits, fire extinguisher locations, and evacuation routes upon arrival at the venue
- Call 911 immediately in the event of any emergency requiring police, fire, or medical response
- Follow the Host's posted emergency procedures and evacuation plans
- Notify the Host and EventSpace of any incident or emergency that occurs during your event as soon as it is safe to do so
- Not block, obstruct, or lock any emergency exits or evacuation routes during your event
- Have access to a charged mobile phone for the duration of the event
Emergency Contact Information: In a life-threatening emergency, always call 911 first. For non-emergency safety concerns, contact EventSpace support through the platform or at support@eventspace.ca.
6. Photo & Media Consent
You acknowledge and agree that:
- Hosts may have security cameras in common or exterior areas as disclosed in their listing (cameras are not permitted in private areas such as bathrooms or bedrooms)
- EventSpace may use anonymized or aggregated data about bookings and events for marketing and promotional purposes
- If you voluntarily share photos or reviews on the EventSpace platform, they may be displayed publicly and used in accordance with our Terms of Service
- Any photos or media you capture during your event at the venue are your responsibility; you must obtain appropriate consent from attendees
If you do not wish to be recorded or photographed, please confirm with the Host regarding the location and operation of any security cameras before your event.
7. Age Confirmation
By completing a booking on EventSpace, you confirm that:
Legal Age
You are at least 18 years of age and legally capable of entering into a binding agreement.
Minor Supervision
If minors (under 18) will be attending the event, you confirm that they will be supervised by a responsible adult at all times.
Alcohol Compliance
If alcohol will be served, you confirm that all consumers are of legal drinking age (19+ in Ontario) and that service complies with applicable laws.
Booking Authority
You have the authority to agree to these terms on behalf of yourself and all attendees of your event.
Acknowledgement
By completing a booking on EventSpace, you confirm that you have read, understood, and agree to all the terms in this Guest Waiver and Liability Release. This agreement applies to each booking you make on the platform.
